As a provider of web site hosting and other Internet-related services, HOSTAMITY.COM offers its customer (also known as “Subscribers”) and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. HOSTAMITY.COM respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, HOSTAMITY.COM reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, HOSTAMITY.COMhas developed an Acceptable Use Policy (“AUP”), which supplements and explains certain terms of each customer’s respective service agreement, and is intended as a guide to the customer’s rights and obligations when using HOSTAMITY.COM services. This AUP will be revised from time to time.
One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet’s openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that HOSTAMITY.COM cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Because HOSTAMITY.COM cannot monitor or censor the Internet, and will not attempt to do so, HOSTAMITY.COM cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications.
When subscribers disseminate information from the Internet, they must keep in mind that HOSTAMITY.COM does not review, edit, censor or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over HOSTAMITY.COM network and may reach a large number of people, including both subscribers and non-subscribers of HOSTAMITY.COM, subscribers’ postings to the Internet may affect other subscribers and may affect HOSTAMITY.COM goodwill, business, reputation or operations. For these reasons, subscribers violate HOSTAMITY.COM policy and the Service Agreement when they, their customers, affiliates or subsidiaries engage in the following prohibited activities:
Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward HOSTAMITY.COM, but also because it can overload HOSTAMITY.COM network and disrupt service to HOSTAMITY.COM subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, HOSTAMITY.COM will investigate and shutdown the account that is SPAMing. A Rs. 12000 charge for violating this policy will be charged to the person initiating the SPAM. Furthermore HOSTAMITY.COM reserves the right to prosecute for this violation. A Rs. 100 charge will be assessed PER EMAIL sent should HOSTAMITY.COM choose to pursue and prosecute.
Audio/Video Streaming is not shared hosting friendly. As such, HOSTAMITY.COM does not allow any streaming of audio or video content. Offending accounts will be suspended without noticed or terminated. Check out our dedicated server for video hosting.
HOSTAMITY.COM does not allow adult content and will suspend/terminate any offending account.
“Unlimited” Term for Hosting:
HOSTAMITY.COM OFFERS ITS SERVICES TO HOST WEB SITES, NOT TO STORE DATA. USING AN ACCOUNT AS AN ONLINE STORAGE SPACE FOR ARCHIVING ELECTRONIC FILES IS PROHIBITED AND WILL RESULT IN TERMINATION OF HOSTING SERVICES WITHOUT PRIOR NOTICE.
Large File Policy:
HOSTAMITY.COM is not for file hosting and distribution – as such, customers may not host any files larger than 50MB in size that are observed to be available for the sole purpose of download. Such files include but are not limited to .ISO, audio/video files, .EXE files. If you are unsure whether your file is against this policy, please e-mail email@example.com
Obscene Speech or Materials:
Using HOSTAMITY.COM network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. HOSTAMITY.COM is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.
Defamatory or Abusive Language:
Using HOSTAMITY.COM network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.
Forging of Headers:
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
Illegal or Unauthorized Access to Other Computers or Networks:
Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual’s system (often known as “hacking”). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).
Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities:
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.
Facilitation a Violation of this AUP:
Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.
Export Control Violations:
Exporting encryption software over the Internet or otherwise, to points outside the India.
HOSTAMITY.COM reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.
Other Illegal Activities:
Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.
Engaging in activities, whether lawful or unlawful, that HOSTAMITY.COM determines to be harmful to its subscribers, operations, reputation, goodwill or customer relations.
As we have pointed out, the responsibility for avoiding harmful activities just described rests primarily with the subscriber. HOSTAMITY.COM will not, as an ordinary practice, monitor the communications of its subscribers to ensure that the comply with HOSTAMITY.COM policy or applicable law. However, when HOSTAMITY.COM becomes aware of harmful activities, it may take any action to stop the harmful activity, including, but not limited to, removal of information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or any other action deemed appropriate by HOSTAMITY.COM.
HOSTAMITY.COM is also aware that many of its subscribers are themselves providers of Internet services, and that information reaching HOSTAMITY.COM facilities from those subscribers may have originated from a customer of the subscriber or from another third party. HOSTAMITY.COM does not require its subscribers who offer Internet services to monitor or censor transmissions or web sites created by customers of its subscribers. HOSTAMITY.COM reserves the right to directly take action against a customer of its subscribers. Also, HOSTAMITY.COM may take action against the HOSTAMITY.COM subscriber because of activities of a customer of the subscriber, even though the action may affect other customers of the subscriber. Similarly, HOSTAMITY.COM anticipates that subscribers who offer Internet services will cooperate with HOSTAMITY.COM Technologies in any corrective or preventive action that HOSTAMITY.COM deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of HOSTAMITY.COM policy.
HOSTAMITY.COM will not intentionally monitor private electronic mail messages sent or receive by its subscribers, unless required to do so by law, governmental authority or when public safety is at stake. HOSTAMITY.COM may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, HOSTAMITY.COM may disclose information, including, but not limited to, information concerning a subscriber, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation or governmental request. HOSTAMITY.COMassumes not obligation to inform the subscriber that subscriber information has been provided and, in some cases, may be prohibited by law from giving such notice. Finally, HOSTAMITY.COM may disclose subscriber information or information transmitted over its network where necessary to protect HOSTAMITY.COM and others from harm, or where such disclosure is necessary to the proper operation of the system. HOSTAMITY.COM expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of online communications. A subscriber’s failure to comply with those laws will violate HOSTAMITY.COM policy. Finally, HOSTAMITY.COM wishes to emphasize that, in signing the Service Agreement, subscribers indemnify HOSTAMITY.COM for any violation of the Service Agreement, law or HOSTAMITY.COM policy resulting in loss to HOSTAMITY.COM or the bringing of any claim against HOSTAMITY.COM by any third party. This means that, if HOSTAMITY.COM is sued because of a subscriber’s or customer of a subscriber’s activity, the subscriber will be responsible for payment of any damages awarded against HOSTAMITY.COM, plus costs and reasonable attorney’s fees.

Domain Names and Domain Transfers
In order for your domain name to point to the HOSTAMITY.COM server your new account is located on, you must change your DNS (Domain Name Servers) at your registrar. These DNS are located in your welcome email and they are defined in a pair (primary- ns*.HOSTAMITY.COM and secondary- ns*.HOSTAMITY.COM). Please note: Our DNS are unique to each server so if you sign up and then a few months later open another account, you will not be using the same DNS as before.
Please be aware that the above process is not known as a domain transfer. A domain transfer is if you want to physically transfer your domain to HOSTAMITY.COM and away from your original registrar. You must create an account at HOSTAMITY.COM and initiate a transfer. A domain transfer is $12.99 and that goes toward one year of registration with HOSTAMITY.COM, added on to your current registration period with the previous registrar.
HOSTAMITY.COM will take necessary steps to register domain names on behalf of the client when requested. However, clients are responsible for renewing their domain names. HOSTAMITY.COM does not take responsibility for failing to renew domain names. Please note that domain registration is irreversible. If your domain name was registered via our company, you must check and take appropriate actions to renew a domain that is about to expire. We do not handle renewals unless specifically asked for by sending a ticket to our helpdesk. HOSTAMITY.COM, believes in freedom of speech; however, any content (written, visual, or implied) in the following areas will not be tolerated and is grounds for immediate suspension of service (in most cases customer will be allowed a zip file of their account): racism or prejudice due to color, creed, or belief; any violent/malicious/obscene content written, visual or implied. We will not tolerate any type of hate site including terrorist related websites on our network. If we receive notice that there is such a hate site hosted within our network, the customer hosting the material will be notified immediately. They are required to remove the content within a certain timeframe or will face account suspension and/or termination.
We prefer that you self-govern your content and remain responsible and all-knowing of what your website publicly provides. Even if other users have access to your account, you are responsible for their actions. The resources and time needed to govern our servers by checking each website individually, which have growing and evolving content, is impossible. However, if HOSTAMITY.COM, is made aware of any questionable content on a HOSTAMITY.COM-hosted site, we will address the concerns immediately and directly with you to seek an amiable resolution. If any person contacts us about content they have found on a HOSTAMITY.COM server that copyrights their own material or that they wish to be removed, we require a proper DMCA notice to begin investigation.
HOSTAMITY.COM, makes no endorsement, claims, or promises regarding the services offered by our customers and will not be held liable for any disputes or claims against said customers. In no event shall HOSTAMITY.COM, be liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use or performance of a customer web site or from any information, services or products provided through a customer web site. If there is questionable content on any server in our network, we will not take any action against any material or action until the website is brought to our attention by contacting our abuse department.
Hosting Package Modifications
We are always evolving to stay competitive in our market so, in the future, if modifications are made to your respective plan’s specifications and/or price, the change will not automatically take effect on your plan. It is the sole responsibility of the client to request any updates or modifications to a plan.
Registrant Rights & Responsibilities

Payments and Agreement to Pay
As consideration for the software or services purchased by you and provided to you by HOSTAMITY.COM, you agree to pay HOSTAMITY.COM at the time you order. All fees are due immediately and are non-refundable unless otherwise expressly noted, even if your services are suspended, terminated, or transferred prior to the end of the services term. HOSTAMITY.COM expressly reserves the right to modify pricing through email notification and/or notice on its web site. You may make payment by providing either a valid credit card or PayPal email address.
Shared hosting, reseller hosting, dedicated servers and collocation services are all billed on an automatic basis on the first of every month. Regular monthly charges will begin the following month. If you sign up for an annual plan you will also be charged a prorated amount and billed on a similar fashion. HOSTAMITY.COM will automatically renew your services when they come up for renewal and will take payment from the payment method you have on file with HOSTAMITY.COM at HOSTAMITY.COM’s current rates.
If for any reason, HOSTAMITY.COM is unable to charge your payment method for the full amount owed, or if HOSTAMITY.COM is charged a penalty for any fee it previously charged to your payment method (such as a charge back dispute), you agree that HOSTAMITY.COM may peruse all available remedies in order to obtain payment. You agree that among the remedies HOSTAMITY.COM may peruse in order to effect payment, shall include but will not be limited to, immediate cancellation without notice to you of any domain names or services registered or renewed on your behalf.
You agree that you are solely liable for arranging that your services are renewed, and that HOSTAMITY.COM shall not be liable to you or any third party if it is unable to charge your payment method in order to renew your services. You also agree that you are liable for all services that have been rendered on your behalf until a termination of service has been officially received by the account holder for services.
If at any time, your hosting payments become past due, you will receive a notification via email (to the most recently updated email address on file) with instructions on rectifying the situation. Please note that HOSTAMITY.COM holds the right to deny access to and/or de-activate accounts hosted on our servers of which have unpaid past due balances.
Shared/Reseller Accounts 10 days past due will be assessed a late fee calculated at 30% of the balance due to re-activate service.
Dedicated Server Accounts 4 days past due will be assessed a $20.00 USD late fee to re-activate service.
VPS Accounts 4 days past due will be assessed a $10.00 USD late fee to re-activate service.
If an account holder submits a bank assisted dispute for services rendered, their hosting account will be de-activated within 48 hours if the payment issue has not been recovered. A $50.00 charge back fee will be added to the amount disputed by the customer.

Any debt not paid 45 days after the due date will be forwarded to an outside collections agency for proper collection. At that time, the account holder will incur a $50.00 USD collection fee added to the balance previously due.

All dedicated server and collocation server invoices will be generated by the 25th day of each month.
All server invoices are due on the first of the month unless otherwise specified on your invoice.
Invoices are considered as late after the 4th day of the month. After this date, past due clients will be subject to suspension and a $15.00 late fee will be applied.
Suspensions will run between the 5th through the 7th day of each month. We avoid running suspensions over the weekend in order to avoid inconveniencing our clients with prolonged downtime.
Our service plans are designed to accommodate the majority of usage scenarios given the needs of our customers. However, your usage may vary and require additional allocations, specifically in the areas of storage and traffic. We will never charge your card automatically if your account requires more resources. You must keep your email address updated within your cPanel, so that you may receive an email when your account reaches certain limits determined solely by our system, ie. bandwidth exceedment warning at 80% at which time you may contact us to purchase a higher transfer quota for your account. If you do not contact us, the system will suspend your site if your allotments exceed.
Shared/Reseller/Dedicated/VPS/Colocation Accounts – If you wish to cancel your services, you must complete cancellation form five (5) business days prior to your renewal date. If your notice of cancellation is not received within this time frame, you will be liable for payment of the proceeding month and hereby agree to complete payment as invoiced accordingly.
If you cancel your account and your payments still continue to recur for any reason such as 1) by fault of HOSTAMITY.COM staff 2) by fault of the credit card processor 3) by fault of any other payment collection company, we are to be held free of liability for any overdraft fees that are issued by your financial institution.
If, for any reason, HOSTAMITY.COM fails to deliver said services to you, a prorated refund will be issued. No refunds will be issued if abuse of our stated policies forces HOSTAMITY.COM to suspend or terminate your services prematurely. In the event you request account cancellation, once your service has been cancelled your account will be suspended from use. It will then be deleted within 25 days. Cancellations of accounts pre-paid for on a monthly basis will not receive a refund for the remainder of the billing period. Cancellations of accounts pre-paid on a yearly basis will only receive a pro-rated refund based on the monthly rate of the same hosting plan. All add-on service payments are non-refundable as they are included only during the life of the hosting plan. If for any other reason your account becomes suspended and remains suspended it will be deleted after a 30-day period.
Bandwidth Usage Policy
All dedicated and colocated servers are given access to bandwidth graphs which are updated in five minute intervals. These graphs are located in the client access area reffered as CORE. All bandwidth billing is exclusively calculated based on the graphs provided in CORE.
All leased and co-located server plans include a specific continuous allocated data transfer rate. Depending on the plan that you have the bandwidth usage included may vary. For example purposes, a plan with an allocated bandwidth of 1,500 GB of data transfer monthly is equivalent to a transfer rate of 4.5 Mbps in a 30-day calendar month. If your monthly usage exceeds the bandwidth transfer rate of 4.5 Mbps within your monthly billing cycle, you will be billed for overages exceeding 4.5 Mbps based on 95th percentile metering. In accordance to these terms of service, you are liable and agree to pay such overages at the rate of $75.00 per 1 Mbps of bandwidth.

Bandwidth used for x month = 5.0 mbps (based 95th percentile metering)
Bandwidth overages = 5.0 mbps – 4.5 mbps = 0.5 mbps
0.5 mbps x $75.00/mbps = $37.50

Note: For calculation purposes, our accounting system defines one month as 30 days. Based on this definition the rate of 1 Mbps of continuous data transfer in a one month period is approximately 333.33 GB of bandwidth a month.

HOSTAMITY.COM, Inc. provides free cPanel account transfers for all new accounts (less than 25 days from sign-up date). Transfer requests submitted after this 25-day period are subject to transfer fees based on source account size. Please contact a member of our sales team for more information. All transfers from remote networks (servers hosted outside of the our data centers) are not guaranteed. There are many factors that can affect remote transfers that may be out of our control (poor network connections, firewalls, missing/incorrect account credentials, corrupted source account data, etc.). We can only promise that we will make our best effort to transfer your data to our servers. If we are unable to complete the transfer, we will let you know so that you can handle the transfer yourself. We also cannot be held responsible for the integrity of your transferred data.
